Yettel Application Terms of Use

Summary of the use the Application

We have summarised the basic information needed to use the mobile application, but before you can start using it, you must accept the Terms of Use.

The Yettel application is Yettel’s software that can be downloaded to your mobile phone and used for free. The application can be used to access information about your subscription (corresponding to the level of customer identification), order and modify services, pay bills, top up your balance, start parking or, if you do not have a Yettel subscription, to find out about Yettel services and – in the case of certain plans – to start concluding a subscription contract.

You can also get in touch with us in the application, using chat or by calling our call centre for assistance. By chat, you are identified in the application, but the call centre may ask for additional ID to start helping you. The application also gives you the opportunity to book an appointment for in-person support at a Yettel store.

The application is the property of Yettel Magyarország Zrt., and Yettel grants you the right to install, run and use the application on your mobile device. Any use beyond this, in particular for commercial purposes, requires the prior written consent of Yettel. More information on this is available in the intellectual property rights section of the detailed terms and conditions below. 

The application only works on iOS, Android and Huawei operating systems and your device must meet the technical requirements of the application. Download the application for free on your phone from Google Play, Huawei AppGallery or the Apple App Store. 

The application generates data traffic, but it is free to use. You need a stable internet connection to use the application. This can be mobile data or Wi-Fi.

You do not have to register to use the application. You can log in with a one-time, generated SMS code, or if you have a Yettel account, with the corresponding email address and password. If you don’t have a Yettel account, you can easily register in the application.

When using the application, Yettel processes users’ personal data. Detailed information on this is available in the Data Protection – Privacy Notice section of the Terms of Use. 

Yettel reserves the right to modify the features and services of the application, to develop the application and to update the application from time to time to the latest version to ensure smooth operation. Yettel sends notification on these.  

The Application and its Terms of Use are available in Hungarian only. We provide hereby the English translation of the Terms of Use only for information purposes.  The Terms and Conditions governing the use of the Yettel Application available here.   The relevant agreement between the user and Yettel shall be concluded in accordance and pursuant to theHungarian version of the Terms of Use and shall be solely governed by those Terms of Use.
 


Yettel Application Terms of Use

By downloading the Yettel Application (hereinafter: Application) and clicking on the "Accept" button at the bottom of the page, you agree to the Application terms of use (hereinafter: Terms of Use) available here. Please note that the use of the Application and the agreement between you and Yettel in relation thereto shall be concluded and governed exclusively by the Hungarian version of Terms of Use available on that link. We hereby provide solely for information purposes the English translation of the Terms of Use. Yettel excludes all liability for any discrepancy between Terms of Use and this English translation thereof, therefore the Hungarian version of the Terms of Use shall be read through before accepting them.

By installing and using the Application, the user consents to the automated processing of partially personal data (so-called usage data) generated during the use of the Application, including data analysis and profiling. The scope of the personal data processed is set out in the relevant section of the Terms of Use.  
 

1. Yettel Application

The owner and operator of the Application and the holder of all rights relating to the Application is Yettel Magyarország Zrt. (registered office: H-2045 Törökbálint, Pannon út 1, company registration number: 13-10-040409, hereinafter: Yettel or Operator). The use of Yettel’s Application is free and it can be downloaded to a mobile phone. By downloading and using it users can access information and perform actions related to the subscriber contract with Yettel as an electronic telecommunications operator including (i) balance information, (ii) information about their tariff plan, (iii) actions related to service configuration and settings, and (iv) use certain services specified in the Operator’s General Terms and Conditions (GTC, www.yettel.hu/altalanos-szerzodesi-feltetelek) and set out in these Terms of Use, the availability and use of which are subject to the appropriate level of customer identification of the user of the Application; and (v) other information and services that are independent of subscriber or user status aimed at telecommunications service, e.g.  users may grant consent or modify or withdraw consent at any time in accordance with the provisions of Annex 2 of the Operator’s GTC (Privacy Notice) in connection with the subscription contract. In addition to the above, users can initiate concluding subscription contracts for certain tariff plans via the Application.
The GTC applies to the use of the Application in connection with the subscriber relationship, in particular to services ordered and/or used via the Application (including through Yettel’s website and its online store that are embedded in the Application using the webview function but are available on the internet), changes to the quality and quantity of services, invoice payments and customer service options available in the Application, unless otherwise provided for in these Terms of Use or in the specific terms of use applicable to Yettel’s website and services. Unless otherwise provided for or specifically contained in these Terms of Use, the use of the Application and the rights and obligations of the user are governed by the provisions of the Operator’s currently effective GTC. To resolve and remedy complaints and problems arising in connection with the use of the Yettel Application, if this is not possible within the Application, Yettel’s customer service channels as set out in the GTC are available to users. 
External content and pages accessible through the webview function, even if they appear to open within the Application, are subject to their own terms of use governing their content. This includes the Yettel online and online store interfaces that open within the Application, which are governed by the Legal Disclaimer  and Terms of Service applicable to Yettel online pages (available here: https://www.yettel.hu/jogi-kozlemeny (hereinafter: Yettel Online Terms of Use). 

The user acknowledges that the use of the Yettel Application constitutes an information society service. The use of the Application does not allow the user to use electronic telecommunications services, and the user can only initiate the conclusion of a subscription contract for certain tariff plans as specified by Yettel. The Application and these Terms of Use are available in Hungarian only.  The user acknowledges that the Operator does not have a code of conduct for consumers. 
In the event of a consumer dispute, the consumer may contact the competent Conciliation Body in their place of residence, the contact details of which are contained in Annex 6 of the Yettel GTC.  
  
 

2. Intellectual property rights  

The source and object code of the Application (hereinafter: Code), as well as its structure, menu structure, available functions, accessibility, and the design, compilation, arrangement and editing of its content, as well as the content displayed in the Application (hereinafter: Content) are protected by copyright due to their individual and original nature. Yettel is the copyright owner, which means only Yettel is entitled to authorise others to use any copyrighted material. It is prohibited to reproduce, copy, republish or distribute the Content, in whole or in part, in any form without Yettel’s prior written permission, unless Yettel clearly and expressly states that it authorises any such use. It is also prohibited to create, adapt or modify derivative works from or based on the Content, including, without limitation, fonts, icons, buttons, links, wallpapers, screensavers, text, images, graphics, logos, greetings cards, photographs, audio and video material, or to make available, distribute, market or sell any such material or works without permission. Yettel grants the user a free, non-exclusive, non-transferable, non-sublicensable right of use to download, install and run the Application on their mobile device, i.e., to use the Application for its intended purpose. The scope of the right of use is limited to such intended use and, as such, the user is not entitled to reverse engineer the Code, nor to reproduce, distribute, adapt or modify the Code and the Content, unless this is expressly permitted in the Application (e.g., sharing function in respect of the Content). Any use beyond such use, in particular for commercial purposes, requires the prior written consent of Yettel. Copyright infringement may have civil law (Chapter XIII of Act LXXVI of 1999 on Copyright – Consequences of Copyright Infringement) and criminal law (Chapter XXXVII of the Criminal Code – Crimes Against Intellectual Property Rights) consequences. 
 

3. Amendment of the Terms of Use

Yettel reserves the right to amend these Terms of Use upon prior notice to users. The user can accept the amendment of the Terms of Use of the Application by clicking the “Accept" button. In the absence of acceptance of the amended Terms of Use, access to the Application is not possible, in which case Yettel’s additional customer service channels are available to the user, and the service(s) made available through the Application may be used in other ways as set out in the GTC. Yettel may modify, update, or withdraw the structure, menu structure, available features, accessibility, or all or any part of the Application at any time without notice.  
 

4. Use of the Application

(a)    The user can download the App for free from Google Play, Huawei AppGallery or the Apple App Store. Certain functions of the Application can only be used with an active phone number provided by the Operator. Upon logging into the Application, and after accepting these Terms of Use, the user is required to provide their phone number – if they wish to use the Application and its functions as an existing Yettel customer – and may set up a primary number. The primary number set by the user is the phone number associated with the user that is used to start the Application after log-in. The Operator sends a one-time password to the number, which the user can use to log into the Application. In addition, it is also possible to log in with a Yettel account with the corresponding email address and password (Yettel account registration can also be initiated in the Application if the user does not already have one). If the user logs out (log-out function), a new code is required to log in, or the user must log in again with the Yettel account. Sending the one-time password is free of charge. Taking into account that it is also possible to order and modify certain services in the Application, any passwords used to access the Application (including one-time passwords sent by Yettel to the user’s number for this purpose) must be kept confidential by the subscriber in their own interest and shall not be disclosed to third parties. Yettel is not liable for any damages resulting from the unauthorised disclosure of the password or code. In order to protect their own personal data, the user agrees to notify Yettel without delay upon becoming aware of any unauthorised use of their identifiers or Yettel account. If the user wishes to enter into a new subscription contract, they must log into the Application as described in Subsection h) below.

(b)    In the Application, the user may request assistance by calling the call centre or using video chat. In this case, no customer identification is performed from the Application, and new or additional identification is required in the channel in question. In the Application, the user is given the opportunity to book an appointment in advance at one of Yettel’s points of sale if they need to arrange something in person. They can do this via the contacts menu. Clicking on the link opens the native browser application of the device, through which the user is redirected to the website to book an appointment. 

(c)    If the user is redirected to the Yettel online interface via the webview function from the Application while logged-in, they are automatically logged in to the Yettel online interface, where they have access to Yettel online services with the privileges that come with being logged into the Application. The user can choose to activate biometric identification, which ensures the identification of the person authorised to unlock the device before opening the webview function. This prevents unintentional transactions in or launched from the Application. During the biometric identification process, the Application uses the identification capability of the device’s operating system. Yettel cannot access or manage the necessary data, either in the Application or from the server; the device’s operating system only indicates the success of biometric identification to the Application.  

(d)    In the Application, the device insurance function is available under the Other menu. The homepage of this service displays active device insurance policies for subscriptions associated with the customer’s account, as well as insurance offers available for devices that have already been purchased. The Application provides the option of taking out new insurance for devices without an insurance contract, if an offer is displayed next to the given device. It also allows the user to cancel insurance for devices with an active insurance contract. Ordering, cancelling or viewing details of existing insurance policies requires customer-level privileges. If the phone number is only linked to the customer’s account by SMS code, or if the customer has logged into the Application by SMS code (which means phone number-level access), then the available offers and existing insurance policies are displayed. However, the customer can only order, cancel or view details of existing insurance if they also log in at customer level with the customer-level password. Device insurance can only be taken out on the basis of an available offer. If the storage parameters of the device to be insured are not available, the customer must provide these. The available offers may be updated on a daily basis. For existing insurance, the customer can view the documents containing the insurance details and terms and conditions (General Terms and Conditions of Device Insurance, Affiliation and Device Entry Declaration, Information on Insurance Contracts Concluded Through Distance Selling, Insurance Product Information Document). The conclusion or cancellation of a device insurance contract through the Application is governed by the Device Insurance GTC that Yettel publishes on its website. Since device insurance is a joint service provided by an insurance company contracted with Yettel (Chubb or Maxima) and Yettel, the content of the above legal declarations relating to device insurance and the data related to the making of such declarations through the Application are transferred to one of these insurance companies in accordance with the applicable provisions of the Device Insurance GTC (Chapter XX "Data Protection").

(e)    In the Application, a Roaming menu is available under the Other menu items, where the user can find general information on roaming charges and information available in the various countries. The Application monitors the device’s network and if the network data tells it that the device is on a roaming network, this Roaming menu item appears in the bottom menu. When the user clicks on this it displays a plus button within the menu welcoming the user to the country. Clicking on this button brings up general information for this country. If a foreign network is detected, an extra button appears on the main page of the Application, which the user can click to check the balance of their roaming data quota, if available in the country in question.

(f)    When logging in with a one-time password or a Yettel account, the default function is to remain logged in (“Stay logged in" function). In other words, the Application does not automatically log the user out. If the user does not wish to use the logged-in status function, the option to turn it off is available on the log-in screens. 

(g)    Use of the Application generates data traffic. Data traffic through the Application is free of charge, but if the user accesses a function or service embedded in the Application through a third-party access point outside of Yettel (e.g. embedded Google Maps) or accesses content outside the Application by clicking on links to third party websites, data traffic is subject to a fee (subject to the terms and conditions of the relevant tafiff plan). The data traffic associated with the use of Yettel’s electronic payment service provider, Barion Zrt., is free of charge. 

(h) In the Application, the user may start concluding a new subscription contract for certain tariff packages and, upon successful completion of the customer identification process, may conclude the subscription contract – in the steps described below – by providing the necessary data for the conclusion of the contract, making certain declarations related to the processing of personal data, and by accepting the GTC. The detailed conditions relating to the conclusion of the subscription contract and the services to be provided thereunder are set out in the GTC. To start the contracting process, the user must select the new subscriber contracting option on the home screen when opening the Application.

•    Specification of selected SIM card type, selection of phone number / initiation of number porting 
To start concluding a subscription contract, the user must select a phone number or initiate number porting and select the type of SIM card they require. An eSIM can only be requested for an eSIM-enabled device.

•    Creating a new Yettel account or logging into an existing Yettel account
To start the subscriber contracting process, the user must create a new Yettel account or log in with an existing Yettel account and confirm it with the 6-digit code received by email. 


•    Customer identification process relating to a new subscription
Only users over the age of 18 are entitled to start concluding a subscription contract. The user must declare this fact upon starting the contracting process. 
Concluding a contract requires the successful completion of the customer identification process through the Application, the essential material and technical requirements of which are:
-    a valid, undamaged, official   identity document of the type indicated on the Application interface,
-    the device having a camera that can take a photo of the required quality, and the availability of the selfie camera function,
-    permission to use the device’s camera as indicated in the Application interface and the ability to take high-quality images on the device in line with the messages displayed in the Application interface, which allow the scanning of the identification document data and the identification of the user,
-    availability of a valid official document certifying the user’s address 
Once the account has been registered, access to the device’s camera is required to start the customer identification process. The user who is starting the contracting process must take a photo of the front and back of their identification document, and if the scan is successful, they need to take a selfie. If the user notices a discrepancy between the data on the identification document and the scanned data (displayed in the Application interface), they can manually correct the contracting party’s data in the Application interface. After successful identification of the subscriber  initiating the conclusion of the subscription contract, the data of the subscriber as indicated on the contracting party’s address card must be provided. If the service provided by third parties to the Operator for customer identification is unavailable, the user must manually enter the identification document data oin the Application interface.

•    Selecting a delivery option
After successful customer identification, if a physical SIM card is selected, the user can choose from the delivery options displayed in the Application interface.

•    Order summary, payment
After certain declarations regarding the processing of personal data in connection with the subscription contract have been made, we display the terms and conditions of the tariff package that is the subject matter of the subscription contract in the order summary in the Application. The final step in the process is the user being redirected to the page of Yettel’s payment partner, where the items in the cart can be paid for.
If the process is successfully completed and the payment transaction is concluded, the delivery process, or SIM card activation in case of eSIM, starts.
The status of the delivery can be tracked within the Application.  

(i) The various functions that can be used in connection with a subscription contract through the Application:
•    Digital eSIM download
The Application offers an eSIM download function, which allows the user to download the eSIM for a subscription previously purchased in the Application. The button only appears if the selected subscription has an associated eSIM, the eSIM is in downloadable status, and the device is eSIM-enabled.
•    Ordering a service with a saved bank card
For certain types of subscriptions, the Application provides the option to pay with a saved bank card when purchasing services.
•    Starting a chat with customer service
In the Application, the customer can initiate a chat with customer service.
•    Overview of finances
Within the Application, the user can view the payment transactions made with the saved bank card.
•    Viewing and downloading contract documents
In the Application, the user can download or view Subscriber Contracts, Contract Summaries and Changes to Subscriber Contracts for certain subscriptions.
•    Viewing customer data
In the Application, the user can view subscription-related customer data for certain subscriptions.


5. Mobile Parking and E-Vignette Services in the Application

5.1 Mobile Parking Service and E-Vignette Service

a) Yettel provides the Mobile Parking Service and the E-Vignette Service as Mobile Purchasing Services under the conditions and terms defined in the General Terms and Conditions (GTC) and its annexed Price Lists (hereinafter referred to as the "Price List"), with the modifications and additions outlined in this chapter. The capitalized terms in this chapter are interpreted in accordance with the definitions provided in the present Terms of Use, the GTC, and the Price List.

b) Within the Mobile Parking Service, the Service Provider transmits the user's request to purchase a mobile parking ticket through an IP-based system.

c) The E-Vignette Service in the application enables users to purchase road usage rights for public roads through the electronic sales channel by buying motorway e-vignettes ("e-Vignette") in exchange for a usage fee. The Service Provider transmits the user’s request to purchase the e-Vignette through an IP-based system.

d) The Service Provider's Mobile Parking and E-Vignette purchasing services are based on services sold through centralized mobile sales channels operated by the National Mobile Payment Plc. The Service Provider is authorized to sell only e-vignettes distributed through mobile sales in Hungary as part of the E-Vignette Service.

5.2 Conditions and Fees for Using the Mobile Parking Service

a) The Mobile Parking Service is a mediated service available to Yettel subscribers, enabling them to purchase parking tickets using their mobile devices. Yettel subscribers can pay for parking tickets using their credit limits or the balance loaded onto their universal account. The additional rules for purchasing parking tickets through the Mobile Parking Service are detailed in the GTC and the Price List, available at https://www.yettel.hu/altalanos-szerzodesi-feltetelek.

b) Mobile Parking transactions in the Yettel Application are conducted based on the user’s subscription terms, using either the credit limit or the universal balance to initiate the Mobile Parking Service.

c) The Mobile Parking Service fee: In addition to the parking fee applicable at the location or zone specified by the user, the Service Provider charges only the transaction fee specified in the Price List for National Mobile Parking or Indoor Mobile Parking. The transaction fee is HUF 115 (including VAT) per transaction. The Service Provider does not charge any additional fees for providing the Mobile Parking Service through the application.

d) The user explicitly acknowledges that by approving the start of a Mobile Parking session via the button provided for this purpose, they are authorizing the Mobile Parking transaction to be carried out. Similarly, by approving the end of a Mobile Parking session via the designated button, the user authorizes the completion of the respective transaction.

e) When using the Mobile Parking Service, the user is required to pay the minimum parking fee applicable to the selected parking zone or indoor parking space, even if the user ends the session before reaching the time equivalent to the minimum fee.

f) Within the Mobile Parking Service, a single phone number added in the application can only start or stop parking for one license plate at a time.

g) Upon initiating a parking session, if location data is available, the application will suggest a parking zone based on this information. However, the user is responsible for verifying the accuracy of the suggested zone by consulting the signage and parking ticket machines on-site and confirming or selecting the appropriate parking zone before purchasing the mobile parking ticket.

h) When extending a parking session, the current session will be terminated, and a new session will be initiated. The fee for the new session will be charged according to these Terms of Use.

i) The user is responsible for ensuring that parking complies with the time limits indicated at the parking location and that, if required, the parking session is concluded within the permitted time or the vehicle is moved. The user acknowledges that if the “Commissioned Parking” feature is used, the parking session will be stopped and restarted after the maximum parking time expires, in accordance with the rules of the applicable zone. However, the user remains responsible for moving the vehicle if required by the parking regulations of the zone.

j.) Parking space estimation function: the function within the company's mobile application helps users find an available parking space in Budapest faster and more efficiently. Users have access to a real-time forecast regarding the probability of finding an available parking space on a given street. The algorithm running in the background takes into account the traffic situation, time of day, weather conditions and historical traffic data, thus helping to optimize the parking process.

Users can see in a map view within the application where the greatest chance of finding an available space is.

When using the function, no personal data related to the subscriber, user or parking planning processed or stored.

The use of the function is not mandatory and can be turned off.

5.3 Conditions and Fees for Using the E-Vignette Service

a) The E-Vignette Service is a mediated service available to Yettel subscribers, enabling them to purchase e-vignettes for toll roads in Hungary using their mobile devices. Subscribers can pay for e-vignettes using their credit limits or the balance loaded onto their universal accounts. Additional rules for purchasing e-vignettes through the E-Vignette Service are detailed in the GTC and the Price List, available at https://www.yettel.hu/altalanos-szerzodesi-feltetelek.

b) Transactions in the application for the E-Vignette Service are conducted based on the user's subscription terms, using either the credit limit or the universal balance.

c) The fee for the E-Vignette Service: In addition to the fee applicable to the vehicle category and type of e-vignette, the Service Provider charges only the transaction fee specified in the Price List. (Details of transaction fees are available at https://www.yettel.hu/altalanos-szerzodesi-feltetelek in annexes 1/A and 1/B of the General Terms and Conditions.) No additional fees are charged for providing the E-Vignette Service through the application.

d) The user explicitly acknowledges that by approving the purchase of an e-vignette via the button provided for this purpose, they are authorizing the transaction to be carried out.

e) Only vehicles and trailers included in the usage-based e-vignette system can be registered for an e-vignette in the application. The user is solely responsible for selecting the correct vehicle category for the e-vignette during the transaction process in the application.

f) The Service Provider reminds users that e-vignettes must be purchased before starting road use. The user is solely responsible for ensuring compliance with toll requirements and for purchasing the appropriate e-vignette for the vehicle before using the toll road.

5.5    Complaint management

(a)    The user has the right to lodge a complaint with the Operator regarding any complaint related to MobileParking in accordance with the provisions of the GTC. 
(b)    The Operator – in view of the intermediated nature of the products or services concerned – is competent for considering whether it may investigate and decide on the request or complaint regarding the product or service under the MobileParking. If the Operator does not have full competence to decide on the request or complaint and/or does not have all the information necessary for assessment, it shall ensure that the notification or complaint is answered with the involvement of Nemzeti Mobilfizetési Zrt. If the user contacts the Operator with a request, enquiry or complaint regarding MobileParking products or services, but the Operator concludes after investigating that the parking operator is responsible for responding thereto, the Operator shall instruct the user to forward the request, enquiry or complaint to the above legal entities.
(c)    In the event of a substantiated fee complaint concerning the MobileParking service or a duplication of the transaction due to a technical error, if the consideration of the purchases for the given period has not yet been billed, the user shall be billed for the adjusted amount, whereas if the billing has already been completed, the Operator shall credit the relevant fees in the next invoicing period.

6. Discount Coupons Available in the Application

The Service Provider reserves the right to make discount coupons (hereinafter referred to as “Discount Coupons”) provided by third-party partners available in the Application. These coupons enable the User to purchase or utilize the products and services of these partners under discounted conditions. The User can select which Discount Coupons displayed in the Application they wish to use. By clicking on (activating) a selected coupon, the unique identifier of the discount (its QR code) is displayed, which can be presented to redeem the Discount Coupon at the respective partner.

Activating a Discount Coupon does not create any payment obligation for the User, nor does it impose any obligation to use the coupon. Discount Coupons can only be activated and redeemed within their specified validity period. Any activated but unused Discount Coupons will expire after the validity period ends. The Service Provider explicitly reserves the right to modify the validity period of Discount Coupons or to withdraw displayed coupons before they are activated.

The Service Provider assumes no responsibility for the products purchased or services used through the displayed Discount Coupons; such matters must be resolved directly with the respective third-party partner. It is explicitly the User’s responsibility to ensure the suitability of the product or service associated with the Discount Coupon before redemption. If necessary, the User should review and accept the terms and conditions and privacy policy of the respective third-party partner.

7. Speedtest

This feature allows you to test your current internet speed by measuring latency, download and upload speeds. In addition to Yettel, a third party, Ookla (Seattle, WA, USA), also participates in the measurement.

This feature is used to measure domestic networks, primarily Yettel's network, in Hungary. Using it while roaming reduces your roaming data allowance and generates costs according to the roaming service fees associated with your tariff.

8. Network data collection

In Hungary, it is a function that supports network development. Its use does not reduce your mobile data allowance and does not generate any costs. When roaming, the function is automatically suspended without user intervention. A third party, Ookla (Seattle, WA, USA), is also involved in data collection.
The feature is available on devices using the Android mobile operating system; its use is optional and can be disabled.

    

9. Quiz-related prize games

During the prize game, the participant user must open and then log in to the Yettel application (if they do not have such an application yet, they can download it from https://www.yettel.hu/app) and successfully complete the quiz for the current prize game in the “Quiz” menu item during the promotional period. Registration is automatically made to the CTN selected after entering the application, provided that the user accepts the prize draw rules and terms of use after completing the quiz. Participation in prize games is optional.

     

10. Push notifications sent by the Application and in-app pop-up messages

If the user has given consent for "General marketing contact via the yettel.hu website and its subpages, the Yettel account and Application and other Yettel applications” (hereinafter: marketing consent) and has enabled the relevant settings (e.g. enabling push messages for the Application in the operating system settings), the Application may display direct marketing push messages and notifications. The Application also displays general push notifications and information messages that do not constitute direct marketing, even in the absence of consent, with the proviso that the user has the option of disabling these push notifications in the operating system settings. 
Stopping (unsubscribing) from marketing push messages is possible by withdrawing marketing consent. The Subscriber may modify or withdraw their consent at any time, free of charge, either in person or by telephone, by calling the call centre (1220), or by using the Yettel online interface (online.yettel.hu or fiok.yettel.hu), in writing (by post), or by completing the webform on the Operator’s website (Administration/Customer Service/Written Administration). The user can change the notification phone number at any time in the Application, or disable push notifications in the operating system settings. 
If the user is redirected to the Yettel online interface via the push messages sent by the Application or with a one-time code while logged in, they are automatically logged in to the Yettel online interface, where they have access to Yettel online services and offers with the corresponding privileges.

          

11. Widget function provided by the Application

The Application allows for the use of a widget that displays the quota still available from the limit for the phone number selected in the Application, as well as the phone number or username itself, if set. The data in the widget is displayed without opening the Application after unlocking the phone.

12. Non-acceptance of Operator liability 

Yettel does not accept any liability for the reliability, operability or availability of the Application. Users use the Application solely at their own risk, and the user is solely responsible for any information or data (e.g. login data) that they provide to third parties for the use of the Application or for any information or data required for its use. The user is also responsible for any event or activity that occurs through the use of their login data for the Application. Yettel presumes, with respect to the use of the functions and services of the Application by the user that may affect the subscriber relationship for the given phone number, that the user does so with the knowledge and consent of the subscriber, if the user and the subscriber of the phone number in question are not the same person. In this case, the subscriber is liable for the conduct of the user through this Application in respect of the subscriber relationship. 
Yettel is not liable for any damage resulting from improper or incorrect use or for any pecuniary, non-pecuniary, consequential damage or lost profits arising from the use of the Application. 
Yettel may place links to third party websites (such as payment-related sites) in the Application, but it is not liable for these sites, or the content and functions on such third party websites, the services provided by them, and the personal data to be provided to use such sites and the processing thereof, and it is not liable for any damages arising from the use of these sites. Such sites and their use are subject to the terms of use of third party service providers. 
The user acknowledges that Yettel is not responsible for any error, virus damage or any loss of data on the user’s mobile device, unauthorised access to the user’s mobile phone or any other damage caused by third parties or force majeure. 
By using the MobileParking service, the user acknowledges that they are obliged to comply with all legal provisions and other regulations (in particular the rules of the parking facility) applicable in the place of parking, as well as to comply with the signs, boards and other notices posted in the parking facility, whether permanent or temporary, and to park their vehicle taking into account any parking restrictions. The user acknowledges that in the case of payment of the parking fee with a vehicle using the MobileParking service, Yettel does not accept any liability for any fines, surcharges or other legal consequences imposed on the user in connection with the parking of a vehicle, including if the reason for the fine, surcharge or other legal consequence is based in particular, but not exclusively, on one or more of the following facts and circumstances:
-    the user has not started the MobileParking transaction in the Application in the parking fee zone in which the vehicle is parked, 
-    the user is parked in a place where the vehicle or the vehicle type in question is not allowed to park or stop,
-    the user is parked with a different type of vehicle than the one indicated in the Application when starting the MobileParking transaction,
-    the user has violated the legal provisions or other rules applicable in the place where the car park is located (e.g. parking facility rules),
-    the user has exceeded the parking time specified in the mobile parking ticket purchased through the MobileParking service.

              

13. Proper use of the Application 

The user may use the Application in accordance with these Terms of Use for its intended purpose. In particular, but not exclusively, the user is not entitled to: 
– modify or reverse engineer any part of the Application; 
– use any automated application, search bot, page finder or reverse engineering or any other application that allows for the modification of the Application or any part thereof; 
– reformat or edit any part of the Application; 
– generate, obtain or attempt to obtain a user password by automated means or by fraudulent or dishonest means; 
– access data, information or services that are not intended for users, or log onto a server or with an identifier for which the user has no privileges; 
– probe, spy on, or test the vulnerability of the system or network, or circumvent, override, overload, or otherwise violate system security or access control measures without proper authorisation and privileges. 
Indemnification, compensation: the user is fully liable to Yettel for any damages of any nature, including actual and consequential damages, arising from the improper and unintended use of the Application or from the breach of these Terms of Use. 
The user may use the Application in accordance with these Terms of Use for its intended purpose. In particular, but not exclusively, the user is not entitled to:

– use any automated application, search bot, page finder or reverse engineering or any other application that allows for the modification of the Application or any part thereof;

14. Data protection – Privacy Notice

More information on data processing related to the subscriber relationship, including profiling in connection with the telecommunications service, is contained in Annex 2 of the GTC (Privacy Notice).

Information on data processing in the Application for the various tariff plans, in relation to the customer identification procedure described in Subsection 4.h) of these Terms of Use and the use of the chat function described in Subsection 4.i) is available in Annex 2 (Privacy Notice) of the GTC. 

(a)    Data processing related to login to the Application
The purpose of data controlling: Customer-level or phone number-level privilege authentication required for logging into the Application.
Legal basis for processing: performance of a contract (Article 6(1)(b) of the GDPR).
Scope of data processed: the user’s phone number or the primary number set by the user or the one-time login password sent to the phone number; when logging in with a Yettel account, the email address and password associated with the Yettel account; the username provided by the user; in case of biometric identification, the result of the identification.  
Duration of processing: One year from the termination of the underlying subscription contract or from the deletion of the Application or the Yettel account used to use the Application (whichever is shorter).
Data processors and other recipients: 
•    Data processor: BloomReach B.V. (Oosteinde 7, 1017 WT Amsterdam, Netherlands);

(b)    Data processing in connection with the provision of Yettel services available in the Application
By using the Application, the user agrees that the Operator may link the phone number provided to the existing subscription contract upon the first use of the Application in order to provide the functions and services available in the Application aligned with the user’s needs. 
Purpose of processing: to provide the functions and services available in the Application (e.g. tariff plan administration, balance top-up for prepaid subscribers, purchase of additional data, purchase of other services, invoice payments), video chat, webview, store finder, in-store appointment booking; information on Yettel services, such as current consumption, available data, balance information, tariff plans; support for the use of various Yettel services; detection of foreign networks; management of user consent declarations.
Legal basis for processing: performance of a contract (Article 6(1)(b) of the GDPR). 
Scope of data processed: data processed on the basis of the subscription contract for the given phone number necessary for the provision of the functions and services of the Application by the Operator and network data (cellular identifier) in connection with the detection of foreign networks.
Duration of processing: One year from the termination of the underlying subscription contract or from the deletion of the Application or the Yettel account used to use the Application (whichever is shorter).
Data processors and other recipients:
•    Data processor: BloomReach B.V. (Oosteinde 7, 1017 WT Amsterdam, Netherlands);

(c)    Store locator function and coverage map search function
Purpose of processing: identifying the nearest store to the user in the Application.
Legal basis for processing: user consent, which can be recorded on the user’s device (Article 6(1)(a) of the GDPR). Consent can be withdrawn at any time in device settings.
Scope of data processed: location data recorded on the device.
Yettel does not process or store the data and cannot provide any information in this regard.

(d)    Processing of data generated through the use of the Application for profiling and sending personalised offers
Purpose of processing: (i) development of the service and enhancing the customer experience by analysing and using the data and personal characteristics generated through the use of the Application (Profiling); (ii) creating and sending personalised offers (Personalised Offers). 
Legal basis for processing: consent (Article 6(1)(a) of the GDPR) to processing for the purpose of profiling and sending Personalised Offers.
Scope of personal data processed: login, usage data, data related to measuring the performance of the Application: e.g. page load, application start time, version; data related to interactions, activities, behaviour within the Application: e.g. recordings and heat maps of the use of the Application; touches within the Application; data about the user’s device: e.g. device type, operating system, system ID, IP address, language; information related to the settings of services, such as text description of the activity performed. 
Duration of processing: until the deletion of the Application or the Yettel account used to use the Application. 
Data processors and other recipients: 
Data processor: BloomReach B.V. (Oosteinde 7, 1017 WT Amsterdam, Netherlands). 
Some of the usage data generated by the use of the Application is processed anonymously, i.e. these do not relate to an identified or identifiable natural person. On Apple iPhone devices, this is ensured by the App Tracking Transparency framework introduced by Apple. Usage data collected anonymously is not personal data, which means that no consent is required for its collection and further processing. 

(e)    Processing in relation to the provision of the MobileParking service of the Application
Purpose of processing: provision of the MobileParking service.
Legal basis for processing: performance of a contract (Article 6(1)(b) of the GDPR), including the billing of fees arising from the contract and the possible enforcement of claims and rights, as well as complaints handling.
Scope of data processed: mobile phone number, vehicle registration number, vehicle country code and category, parking duration, transaction type, amount payable, transaction date, transaction result (successful / unsuccessful), parking zone.
Duration of data controlling: One year, calculated from the initiation of the transaction by the user.
Recipient of data transfer: Nemzeti Mobilfizetési Rendszer Zrt. www.nemzetimobilfizetes.hu (when parking in a public area), EME Zrt. www.nemzetimobilfizetes.hu (when parking in an indoor car park), except for the mobile phone number.

(f)    Data processing related to the recognition of the parking fee zone when the MobileParking service of the Application is launched
Purpose of processing: identifying the parking fee zone in the Application when the MobileParking service is launched.
Legal basis for processing: user consent, which can be recorded on the user’s device (Article 6(1)(a) of the GDPR). Consent can be withdrawn at any time in device settings.
Scope of data processed: location data recorded on the device. 
Yettel does not process or store the data and cannot provide any information in this regard.

(g)    Data processing relating to location-based notifications in connection with the provision of the MobileParking service
Purpose of processing: notification when approaching the location of the vehicle (a ring around the vehicle with a radius of 10 meters) in the Application during the provision of the MobileParking service. 
Legal basis for processing: user consent, which can be recorded jointly in the Application and on the user’s device (Article 6(1)(a) of the GDPR). Consent can be withdrawn at any time, in the Application and in device settings. 
Scope of data processed: location data recorded on the device.  
Yettel does not process or store the data and cannot provide any information in this regard. 

(h) Data processing related to the E-Vignette purchasing service
Purpose of data processing: To provide the E-Vignette service.
Legal basis for data processing: Performance of a contract (Article 6(1)(b) of the GDPR), including billing for fees arising from the contract, potential enforcement of claims and rights, as well as complaint handling.

(i) Data processing relating to cart abandonment 
The purpose of data controlling: If the order process is not completed by the user, the Operator processes the order data for the purpose of ensuring the completion of the order, after the order process is interrupted, until the end of the retention period. The Operator sends a reminder (in particular an email or push message) within the retention period to inform the user that the order has been interrupted. 
Legal basis for processing: performance of a contract (where applicable, taking steps prior to the conclusion of the contract). 
The scope of controlled data: Email address and device ID entered during the purchase process. 
Duration of data processing: 72 hours from the start of the order process. 

(j) Processing in relation to newsletter subscriptions 
The Operator sends direct marketing messages in electronic newsletters to those who have expressly consented to this. 
The purpose of data controlling is to advertise services and products, and to provide current information about the Operator and its activities.  
Legal basis for processing: consent of the data subject [Article 6(1)(a) of the GDPR]. 
Scope of data processed: email address, last name, first name. Duration of processing: until consent is withdrawn (unsubscription).

(k) Cart abandonment related questionnaire 
The purpose of data controlling: To improve the customer experience, the Operator sends a short, one-time questionnaire related to cart abandonment to improve customer experience.
Legal basis for processing: The legitimate interest of the Operator.
The scope of controlled data: The email address and device identifier provided during the purchasing process, as well as the cookie ID and the responses to the questionnaire.
Duration of data processing: 72 hours from the start of the order process.

(l) Data processing related to the “Flick a gig!” service
The purpose of data controlling: " Flick a gig!" provision of service according to the specified conditions.
Legal basis for data management: user consent.
The scope of controlled data: telephone number and information on whether the user concerned used the service in the current month. 
Duration of data processing: the end of the calendar month of using the service.

(m) Data processing related to Speedtest
Purpose of data processing: providing internet speed measurement service according to the given conditions. The processed data is used by Yettel for network development purposes.
Legal basis for data processing: user consent.
Scope of data processed: geographical coordinates of the measurement and the measurement result.
Duration of data processing: maximum 1 year after the measurement.

(n) Data processing related to the collection of Network Data
Purpose of data management: network development. 
Legal basis for data management: user consent. 
Scope of data managed: geographical coordinates of data collection and the result of data collection. 
Duration of data management: maximum 1 year after measurement.

(o) Data processing related to troubleshooting
The purpose of data management is to ensure the proper functioning of the application, eliminate detected errors, and prevent possible sources of errors.
Legal basis for data processing: legitimate interest of Yettel as a service provider.
The scope of the data processed includes: the customer's device ID, the name of the websites visited in the application and the visit event, cookie and cart ID.
Duration of data processing: 72 hours after using the application.

(p) Data processing related to the “Netville” game
The purpose of data controlling: "Netville" provision of game according to the specified conditions.
Legal basis for data management: user consent.
The scope of controlled data: telephone number and the identifiers of the town installment successfully completed in the “Netville” game, whether it was successful/unsuccessful and the date of the last use of the game. 
Duration of data processing: 90 days after the last use of the game.

(q) Data processing related to quiz-related prize games
Purpose of data processing: to provide a prize draw according to the specified conditions. 
Legal basis for data processing: user consent.
The scope of the data processed: telephone number, prize game identifier and date of application for participation in the prize game.
Duration of data processing: 90 days after participating in the prize game.

(r) Data processing related to discount coupons
Purpose of data processing: providing discount coupons according to the specified conditions.
Legal basis for data processing: user consent.
The scope of data processed: phone number and unique identifier of the redeemed discount coupon, date of coupon redemption.
Duration of data management: 90 days after the expiration of the discount coupon.

(s)    User rights and legal remedy options in connection with processing
The user is entitled to request information on the processing of their personal data processed by the Operator, and to exercise the following rights: 
a)    right of access; 
b)    right to request rectification; 
c)    right to request the erasure of data; 
d)    right to request restriction of processing; 
e)    right to object to the processing of personal data; 
f)    right to receive the personal data and right to transfer those data to another controller if the statutory prerequisites are met (right to data portability); 
g)    if personal data are processed on the basis of consent, right to revoke consent at any time. 
The request regarding the exercise of rights may be sent using the contact details specified, which are as follows: via email to adatvedelem@yettel.hu, or by post to H-2045 Törökbálint, Pannon út 1, by telephone (on the Operator’s customer service telephone numbers) or in person at Yettel’s customer service and sales points. 
In the event of a violation of rights, the data subject may turn to the courts or lodge a complaint with the Hungarian National Authority for Data Protection and Freedom of Information (NAIH, registered office: H-1055 Budapest, Falk Miksa utca 9-11; telephone: +36 1 391 1400; email: ugyfelszolgalat@naih.hu).
